Dear Office of the Attorney General:
Pursuant to Government Code §552.301(b), please accept this “15-day letter” as a request for a ruling on the exception from disclosure of public information. Please reference ORR 2025-10-6 in your response.
BACKGROUND
On October 14, 2025, the Texas Commission on Jail Standards (“Commission”) received a public information request from LeRoy Nellis for records related to complaints, investigations, and custodial incidents.
After clarification, on October 21, 2025, the Commission forwarded responsive materials to the Texas Rangers for review and objection.
On October 28, 2025, the Texas Rangers responded that release of records would interfere with active criminal investigations into the deaths of Alexis Oliva-Garcia, Caleb Matney, and Robert Hill.
“Please be advised that the Texas Department of Public Safety has active criminal investigations… and the release of the requested records at this time would interfere…”
Accordingly, the Commission requested a ruling from the Attorney General and withheld the records.
OBJECTIONS
The Commission requests to withhold death-in-custody files and related investigative materials under Government Code §552.108.
The Commission states that release of these records would interfere with ongoing law enforcement investigations and incomplete administrative reviews.
While awaiting final investigative reports, the Commission continues internal review procedures for compliance with minimum jail standards.
